Terms of Service

By accessing or using TRACE (tracecase.app), you agree to these Terms of Service. If you are accepting on behalf of an organization, you represent that you have authority to bind that organization. If you do not agree, do not use the service.

These terms apply to the current beta version of TRACE. They will be updated before general availability.

TRACE is an AI decision-support system for humanitarian caseworkers. It is designed for use by humanitarian organizations, including NGOs, UN agencies, government humanitarian programs, and their implementing partners, for field case management, protection monitoring, and related humanitarian operations.

You may use TRACE to support your organization's field programs, train caseworkers, and produce case records and reports for organizational use.

You may not use TRACE for:

Commercial resale. You may not white-label, resell, or sublicense TRACE to third parties without a separate written agreement.

Non-humanitarian populations. TRACE is designed for humanitarian field contexts. Use in commercial case management, law enforcement, immigration enforcement, or other non-humanitarian contexts is not permitted under these terms.

Unauthorized access. You may not attempt to access accounts, systems, or data that belong to other organizations or that you are not authorized to access.

Harmful applications. You may not use TRACE in ways that would endanger the people your program serves or expose confidential case data. Use of TRACE must comply with applicable humanitarian data protection standards, including the ICRC's Handbook on Data Protection in Humanitarian Action and your organization's own data governance requirements.

TRACE is currently in beta. It is provided as-is, without warranty of any kind, express or implied. We do not warrant that the service will be uninterrupted, error-free, or that AI outputs will be accurate in all cases. AI-generated risk assessments, referral recommendations, and case documentation require caseworker review before any operational decision is made.

We make reasonable efforts to maintain uptime and data integrity, but we are a small operation and cannot guarantee service-level commitments during the beta period.

To the fullest extent permitted by law, Elke-Esmeralda Dikoume and TRACE are not liable for any indirect, incidental, special, or consequential damages arising from your use of the service, including but not limited to data loss, operational disruption, or decisions made in reliance on AI outputs.

Our total liability for any claim arising from these terms or your use of TRACE is limited to the amount you paid us in the twelve months preceding the claim, or $100 USD, whichever is greater.

Nothing in these terms limits liability for gross negligence, fraud, or claims that cannot be limited under applicable law.

You retain ownership of all data your organization enters into TRACE. We process it on your behalf and in accordance with our Privacy Policy and Data Protection page. We do not claim any rights to your case data.

We process personal data in accordance with applicable data protection law, including GDPR where relevant, and in a manner consistent with the UN Personal Data Protection Framework and the ICRC Handbook on Data Protection in Humanitarian Action. See our Data Protection page for the full framework.

Case data entered into TRACE is stored and processed in accordance with our Data Protection page. We do not transfer case data to jurisdictions outside that region without your written consent.

Neither party is liable for delays or failures in performance resulting from causes outside their reasonable control, including natural disasters, conflict, internet infrastructure failures, or actions of third-party service providers. We will notify you promptly of any such event affecting service availability.

Either party may terminate access to TRACE at any time. On termination, you may request an export of your data. We will delete our copies within 30 days.

We may suspend access if your use violates these terms, poses a security risk, or causes harm to other users or the service.

These terms are governed by the laws of the State of New York, USA. Any disputes will be resolved in the courts of New York County, New York.

We will notify you of material changes to these terms by email at least 30 days in advance. Continued use after that date constitutes acceptance.
